1. THIS POLICY

Specialist App Inc. o/a Repair Specialist ("Repair Specialist", "we" or "us") recognizes the importance of maintaining and protecting the privacy and security of your personal information. Throughout this document, the our website (www.specialist-app.com) (“the Site”) and our mobile app (Repair Specialist) are referred to as our “Digital Services”.

This Privacy Policy (the "Policy") explains the types of customer personal information we collect when you use our Digital Services, by visiting our website, using our mobile app, creating an account, or otherwise you provide us with personal information. The Policy also explains how your personal information is used and the steps taken to ensure your information is handled properly.

We will only collect, use and disclose personal information in accordance with this Policy. This Policy is incorporated into and forms part of the Repair Specialist Digital Services Terms of Use Agreement (the "Terms of Use"), which outline the terms and conditions you agree to when accessing and using our Digital Services.

By accessing and using our Digital Services, or by providing us with any of your personal information, you agree and consent to the collection, use and disclosure of your personal information as outlined in this Policy. If you do not agree with the terms and conditions of this Policy, please do not use our Digital Services or submit any personal information to Repair Specialist.

2. WHAT IS PERSONAL INFORMATION?

Personal information is information that refers to an individual specifically and is recorded in any form. Personal information can include an individual's opinions or beliefs, as well as facts about, or related to, the individual (for example, name, mailing address, phone number and email address).

Anonymous information is information that is not associated or linked with your personal information. Anonymous information does not, by itself, distinguish or identify a specific individual (for example, information collected through technology, including tracking information as you navigate our Digital Services).

Repair Specialist collects both personal information and anonymous information as outlined below.

3. WHAT PERSONAL INFORMATION DO WE COLLECT?

Account Registration and Requesting a Quote

When you register for an account (an "Account") through our Digital Services, Repair Specialist requires that you provide certain personal information, including, in most cases, your first name, your last name, physical address, phone number, a unique email address and a password. Repair Specialist may also collect specific descriptive information about your vehicle, including but not limited to the model, make, year, engine, trim, transmission, mileage and pervious service history

Mechanic Services

To enable the purchase of mechanic services and appointment bookings, we also collect and store billing and payment information (credit card and debit information), as well as your address, telephone number and any other information required to process your purchases. We use a third-party payment processing services called Bamboora, and Cartis to process our credit and debit payments. In addition, we keep a record of your past purchases and may also ask you for information regarding your personal preferences and demographics to better meet your needs.

Bamboora and Cartis’ use of your personal information is governed by their respective privacy policies which may or may not contain privacy protections as protective as this Policy. Surveys, Contests and Special Offers

Repair Specialist collects personal information such as your first name, your last name, a unique email address, as well as your opinion on specific Repair Specialist services in connection with voluntary surveys, to notify you about new services, special promotional programs, promotional offers or any information related to Repair Specialist and the services offered through our Digital Services.

The information you provide by answering optional survey questions may be shared, but only in the aggregate, with advertisers and partners unless we notify you otherwise at the time of collection. If any other information is to be shared with a third party other than Repair Specialist, we will notify you at the time of collection and obtain your consent. If you do not want any personal information shared, you may decline to participate in the survey, promotional program or offer.

Information Collected Using Technology

We may collect information about the computer, mobile telephone, smartphone or other device you use to access our Digital Services.

Like many websites, we use "cookies," and we obtain certain types of information when your web browser accesses our Digital Services. Cookies are small pieces of text downloaded to your computer or mobile device when you visit a website.

The "help" portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Additionally, you can disable or delete similar data used by browser add-ons, such as Flash cookies, by changing the add-on’s settings or visiting the website of its manufacturer. Because cookies allow you to take advantage of some of our Digital Services’ essential features, we recommend you leave them turned on.

Examples of the information we collect and analyze include the Internet protocol (IP) address used to connect your computer or device to the Internet; login; email address; password; computer, device and connection information, such as device and browser type, version and time zone setting, browser plug-in types and versions, operating system, and platform; purchase history; the full Uniform Resource Locators (URL) clickstream to, through and from our Digital Services, including date and time; cookie numbers; and the telephone number used to call our customer service number. We may also use browser data such as cookies, Flash cookies (also known as Flash Local Shared Objects), or similar data on certain parts of our Digital Services for fraud prevention and other purposes. During some visits we may use software tools such as JavaScript to measure and collect session information, including page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.

Repair Specialist will not attempt to associate any anonymous technical information collected with any personally-identifiable information unless we have your consent to do so, we have detected, or reasonably suspect, an attempt to damage or breach the security of our Digital Services, or we are required to do so by law.

Your Location

If you are a customer who is hiring a mobile repair technician using the Repair Specialists mobile app, your location is captured once at the time you make a service request. Your location is then used by the system to identify which technicians or repair shops are near your location, so that the app can display a list of technicians and shops which are near you. When you hire a technician, your location is then shared with the technician at the time of hiring only, so that they know where to go to provide service. Your location is not otherwise captured or used in any way, and after the repair job has been started, your location is no longer requested or used by the Repair Specialists app.

If you are a mobile service technician/mechanic, your location is captured and recorded while you are on duty, even if the Repair Specialists App is running in the background on your mobile phone/device. The app will stop capturing your location when you log out of the app or go "off duty". While you are logged in and "on duty" your most recently captured location is used by the system to help create a list of available mobile technicians who are nearest to customers who request mobile service. The list of nearby technicians is displayed to potential customers with no personally identifiable information, and your location itself is not shown in the list -- the app only shows an estimate of the distance from your location to the repair job site. After you accept a repair job and are traveling to the repair job site, your location is used to display and update your location on a map which is displayed to the customer, so they know when to anticipate your arrival and can assist if you have difficulty locating the repair job site.

4. WHAT DO WE DO WITH THE INFORMATION WE COLLECT

We use the personal information you provide for the purposes for which it was collected and to which you consent. For example, we may use the personal information you provide to:

  1. facilitate the creation and completion of your Account on our Digital Services;
  2. administer our Digital Services;
  3. schedule, reschedule and cancel services;
  4. communicate with you by telephone or email;
  5. process and keep track of your transactions and report back to you;
  6. manage payments for services;
  7. protect against fraud or error;
  8. provide products, services and information requested by you;
  9. recommend products, services and information that Repair Specialist believes will be of interest and provide value to you;
  10. communicate with you regarding updates to our Digital Services, products, services and information;
  11. foster positive user experience;
  12. operate and improve our Digital Services, products, services and information;
  13. contact you about your opinion of existing or potential products, services or information provided via our Digital Services;
  14. respond to your feedback, queries or requests;
  15. create products, services and information that may meet your needs;
  16. better tailor and improve the features of offered products, services and information;
  17. carry out other purposes which are identified to you and to which you consent; and
  18. comply with legal and governmental requirements.

Other than as stated above, Repair Specialist will obtain your express consent (by verbal, written or electronic agreement) to collect, use or disclose your personal information. You can change your consent preferences at any time by contacting Repair Specialist's Customer Service representatives, where our employees can help direct your call to the appropriate department within Repair Specialist. 5. HOW DO WE SHARE PERSONAL INFORMATION?

Repair Specialist is committed to protecting your privacy and, as such, except as described below, we do not sell, transfer or otherwise disclose to third parties the personal information we collect on our Digital Services.

Repair Specialist employs other companies and individuals to perform functions on our behalf. Examples include sending email, analyzing data, marketing assistance, processing credit card payments, and hosting the Digital Services. These third party service providers have access to the personal information needed to perform their functions, but may not use the information for any other purposes.

We may incorporate your non-identifiable information, such as IP address, demographics, geographic data, web usage, for use in aggregate for our own and third party reporting and market research initiatives. We may also share aggregated de-identified information, including information based on email addresses or other personal information, with our advertising and marketing service providers, including third-party media platforms, such social media sites, to allow them to display advertising messages and/or conduct analyses on our behalf. You may contact us using the information provided in the "How to Contact Us" section below to opt-out of this. Please note that even if you opt out, you may still see advertisements; however such advertisements are not displayed to you based on aggregated de-identified information.

We may work with external service providers that store or process personal information on computers located outside of Canada, including, but not limited to, the United States, whose data protection laws may differ from those in Canada. As a result, the personal information may be subject to access requests from both international and U.S. governments, courts, law enforcement officials and national security authorities in the United States or other foreign jurisdiction according to its laws.

We reserve the right to transfer any personal information we hold in the event that we sell or transfer all or a portion of our business or assets to a third party. Further, we reserve the right to disclose any personal information as needed if such information is requested by a law enforcement agency or if we are requested to do so by law, regulation, court order, or by a government entity.

We may also disclose your personal information to third parties if we have reason to believe that disclosing such information is necessary to: (i) conduct investigations of possible breaches of law; (ii) cooperate in any legal investigation; (iii) identify, contact, or bring legal action against someone who may be violating this Policy and/or the Terms of Use Agreement; or (iv) to protect our rights, privacy, safety or property.

You are deemed to consent to disclosure of your personal information for the purposes outlined above. If your personal information is shared with third parties, those third parties are bound by appropriate agreements with Repair Specialist to secure and protect the confidentiality of your personal information.

Repair Specialist retains your personal information only as long as it is required for our business relationship or as required by federal and provincial laws.

6. HOW DO WE PROTECT YOUR PERSONAL INFORMATION?

The security of your personal information is important to us. We maintain administrative, technical and physical safeguards (appropriate to the sensitivity of such information) designed to protect against unauthorized use, disclosure or access of the personal information we collect, including:

  1. physical security measures such as restricted access facilities and locked filing cabinets;
  2. electronic security measures for computerized personal information such as password protection, database encryption and personal identification numbers. We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you enter;
  3. revealing only the last five digits of your credit card numbers when confirming an order. Of course, we transmit the entire credit card number to the appropriate credit card company during order processing;
  4. organizational processes such as limiting access to your personal information to a selected group of individuals; and
  5. contractual obligations with third parties who need access to your personal information requiring them to protect and secure your personal information.

It’s important for you to protect against unauthorized access to your password and your computer. Be sure to sign off when you’ve finished using any shared computer. Unfortunately, no data transmission over the internet can be guaranteed to be 100% secure. As a result, while we are committed to protecting your personal information, we cannot ensure or warrant the security of any information you provide to us.

7. HOW DO I CHANGE OR UPDATE MY PERSONAL INFORMATION?

Repair Specialist keeps your personal information up to date, accurate and relevant for its intended use.

You may request access to the personal information we have on record in order to review and amend the information, as appropriate. In circumstances where your personal information has been provided by a third party, we will refer you to that party.

If you sign up for a Repair Specialist Account, you may review, delete, correct, update or change your information, including information relating to your vehicle and its repair history, on our Digital Services at any time by simply logging into your Account. You may also delete your Account and information from our Digital Services and elect to no longer receive services from us.

8. HOW DO I UNSUBSCRIBE FROM RECEIVING EMAILS?

Repair Specialist may send you newsletters, emails or other communications that may be of interest to you from the our Digital Services or third parties. We will not send you any online newsletters, promotional or similar email communications unless you have provided your consent or we have an ongoing business relationship with you.

If at any time, you prefer not to receive email communications please proceed by

  1. clicking the "unsubscribe" link at the bottom of each email;
  2. logging into your Account and changing your mailing preferences; or
  3. by contacting us at the contact information provided below.

Likewise, if you previously opted not to receive such communications, you may later opt-in by editing your preferences in your Account, or by contacting us.

9. WHAT ABOUT THIRD-PARTY ADVERISERS AND LINKS TO OTHER WEBSITES?

Our Digital Services may include third-party advertising and links to other websites. We do not provide any personal customer information to these advertisers or third-party websites. Repair Specialist strongly encourages you to review the privacy policies posted on third party websites so that you can make an informed decision whether to access or use a third party website.

Sometimes third-party websites and advertisers, or Internet advertising companies working on their behalf, use technology to send (or "serve") the advertisements that appear on our Site directly to your browser. They automatically receive your IP address when this happens. They may also use cookies, JavaScript, web beacons (also known as action tags or single-pixel gifs), and other technologies to measure the effectiveness of their ads and to personalize advertising content. We do not have access to or control over cookies or other features that they may use, and the information practices of these advertisers and third-party websites are not covered by this Policy. Please contact them directly for more information about their privacy practices.

10. CHANGES TO THIS POLICY

Repair Specialist reserves the right to, at any time and from time to time, add to, change, update or modify this Policy by posting such change, update or modification on the Site. Your use of the Digital Services after such amendments are posted by Repair Specialist signifies your acceptance of any revised terms of this Policy. You are responsible for periodically visiting this page to review the terms and conditions of this Policy. You may not change, modify or amend this Policy in any manner.
